Are Collection Notices Required to be Sent by First Class Mail? Fastfax #1143

Feb 06, 2012

Under § 809(a) of the Fair Debt Collection Practices Act (FDCPA), a debt collector must provide a consumer with notice of certain rights under the FDCPA. The notice must be provided in writing within five days after the initial communication in connection with the collection of any debt. This requirement gives rise to the question of the class of mail by which a collection notice must be sent.
